The terms for using The Jay Way application and service.
Agreement and eligibility
These Terms are between you and Brighter Day Software Pty Ltd (ABN 85 682 366 034) for The Jay Way application and service (Jay). By creating an account or using Jay, you agree to these Terms. You must be at least 18 and have authority to provide and manage the child and third-party information you add.
What Jay provides
Jay organises authorised records and provides general, source-grounded information and preparation support. Outputs may be incomplete or wrong and should be checked against the cited source and with an appropriately qualified professional where the matter is important.
Jay does not provide medical, clinical, therapeutic, legal, financial or NDIS advice. It does not diagnose, recommend treatment, guarantee funding or replace professional care. In an emergency, call 000 or the appropriate emergency service.
Your responsibilities
You must use Jay lawfully, keep account access secure, provide only information you are authorised to provide, review important outputs, and not attempt to access another family's data, bypass security, reverse engineer protections, automate abusive traffic or use Jay to harm another person.
Your content
You keep your rights in content you provide. You give Brighter Day a limited permission to host, copy, process and transform it only as needed to provide, secure and maintain Jay in accordance with the Privacy policy. You can remove content using available controls or delete your account.
Subscriptions and Apple
Where a paid iOS subscription is offered, Apple displays and processes its price, renewal and payment terms. Subscriptions renew until cancelled through your Apple account. Deleting Jay does not cancel an Apple subscription. Apple handles billing and refund requests under its rules and applicable law.
Availability and suspension
We may change, suspend or discontinue a feature for security, legal or operational reasons. We may suspend access for a material breach or credible security or safety risk. You may stop using Jay and delete your account at any time.
Consumer rights
Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy that cannot lawfully be excluded, including rights under the Australian Consumer Law.
Apple licence terms
Brighter Day grants you a personal, limited, non-exclusive, non-transferable licence to use Jay on Apple-branded products you own or control, as permitted by Apple. Brighter Day, not Apple, is responsible for Jay, support and product claims. Apple has no obligation to provide maintenance or support and is a third-party beneficiary of these Terms.
Changes, contact and law
We may update these Terms and will publish the new effective date. If a material change needs fresh acceptance, Jay will ask before continued use. Contact hello@thejaywayapp.com with questions or disputes. These Terms are governed by the laws of New South Wales, Australia, subject to any rights you have under laws that apply regardless of this clause.
